Employer Accreditation

STEPS TO EMPLOY SKILLED MIGRANT WORKERS

Under the Accredited Employer Work Visa (AEWV), employing skilled migrant worker involves 3 steps as under:

  • Employer must be an Accredited Employer; and
  • Employer must complete Job Check for job offered; and
  • Employee then applies for the Accredited Employer Work Visa.

EMPLOYER ACCREDITATION

TYPES OF ACCREDITATION
The type of employer accreditation required depends upon whether you are a:

  • Standard Employer (hiring up to 5 skilled migrant workers); or
  • High Volume Employer (hiring 6 or more skilled migrant workers); or
  • Franchisee (No limit on number of skilled migrant workers); or
  • Controlling third party placing migrants with third parties while being the direct employer (No limit on number of skilled migrant workers).

 

REQUIREMENTS

  • Employers must have a viable and genuine business, i.e.
    • Not made a loss in the last 2 years; or
    • Have positive cash flow in each of the last 6 months; or
    • Have capital or investments for business to remain viable; or
    • Have a 2-year plan to ensure business remains viable.
  • Employers must have New Zealand Business Number (NZBN) and New Zealand IRD Number;
  • Provide full name, passport number and date of birth of key people connected with the recruitment process;
  • Declare that the company, employer and those running the company are all compliant with Employment Law and Immigration Law;
  • Commit that everyone connected with the recruitment process will complete online Employment Modules on Employment Rights once within each accreditation period;
  • Commit to providing migrant workers information about working and living in New Zealand and community services in migrant’s local area;
  • Commit to pay all recruitment related costs and not pass them on to the migrants.
  • Commit to allow the migrant worker time during paid work hours to complete the Employee Module within one month from start of employment

 

FEES & PROCESSING TIMES
Employer accreditation application fee depends upon the type of accreditation and are as under:

  • Standard Accreditation – NZ $740;
  • High Volume Accreditation – NZ $1,220;
  • Franchisee Application – NZ $1,980;.
  • Controlling Third Party – NZ $3,870

If you have held Accreditation under the Talent (Accredited Employer) Scheme as on 23 May 2022 that expires on or after 23 November 2022, you may be exempted from paying the application fee for the initial application under AEWV policy.

Standard & High Volume applications are expected to be processed within 10 working days from receipt of completed application by INZ.

VALIDITY

  • Initial Standard and High Volume accreditation is valid for 12 months;
  • Renewal of Standard and High Volume accreditation will be valid for 24 months
  • Franchisee & Controlling Third Party Accreditations including renewals are valid for 12 months

JOB CHECK

The next step after receiving accreditation is to apply for Job Check with Immigration New Zealand and provide the following:

  • An acceptable Job Offer, i.e. the job
    • is for at least 30 hours a week; and
    • pays market rate; and
    • pays at least the median wage of NZ $27.76 unless the job is on the Exempt List
  • Job Description and the ANZSCO Code for the job being offered;
  • Evidence of Advertisement in a leading national website or suitable channel for at least 15 days unless:
    • the job pays at least twice the median wage (NZ $55.52 per hour/NZ $115,481.60 per annum); or
    • the job is on the Green List
  • Draft of the proposed unsigned Employment Agreement.

 

MULTIPLE ROLES
Employers can include multiple roles in a single Job Check provided:

  • the occupation, location, pay and minimum requirements for the job are the same; and
  • the jobs are covered by the same Agreements and same Advertisement (if advertisement is required)

 

FEES FOR JOB CHECK APPLICATION
Job Check application fee is NZ $610 and for reconsideration application (if declined) it is NZ $240.

ESTIMATED PROCESSING TIME FOR JOB CHECK
Estimate processing time for Job Check application is 10 working days.

JOB TOKEN
Upon approval of Job Check, employers will be issued Job Token for each job. Job token is valid for one-time use only and is unique for each job and cannot be re-used. However if the migrant declines the job or work visa is declined, the employer can use the token for another migrant employment and need not re-apply for Job Check again.

JOB TOKEN VALIDITY
Job Tokens are valid earlier of 6 months or until the employer no longer has accreditation.

ACCREDITED EMPLOYER WORK VISA APPLICATION

This is the third and final stage of the AEWV process. Employer will receive Job Token upon approval of the Job Check and will need to provide the same to the proposed employee to apply for the Accredited Employer Work Visa (AEWV).
